Title IX

On April 19, 2024, the U.S. Department of Education released its Final Rule under Title IX, which prohibits discrimination on the basis of sex in education programs or activities receiving federal financial assistance. The final regulations are effective on August 1, 2024.

In summary, the final regulations:

  • Provide full protection from sex-based harassment.
  • Require schools to take prompt and effective action to end any sex discrimination in their education programs or activities—and to prevent its recurrence and remedy its effects.
  • Require schools to provide supportive measures to complainants and respondents affected by conduct that may constitute sex discrimination, including sexual violence and other forms of sex-based harassment.
  • Require schools to respond promptly and effectively to all complaints of sex discrimination with a fair, transparent, and reliable process that includes trained, unbiased decision makers to evaluate all relevant and not otherwise impermissible evidence.
  • Provide schools with flexibility to adapt the regulations’ grievance procedure requirements to their educational communities so that all schools can implement Title IX’s promise of nondiscrimination fully and fairly in their educational environments.
  • Protect students, employees, and applicants from discrimination based on pregnancy or related conditions.
  • Prohibit discrimination against LGBTQI+ students, employees, and others.
  • Protect people from harm when they are separated or treated differently based on sex in school.
  • Protects students, employees, and others from retaliation.
  • Ensure that schools communicate their nondiscrimination policies and procedures.
  • Prohibit schools from sharing personal information.

Title IX of the Education Amendments of 1972 prohibits sexual discrimination in any form to include any form of sexual harassment and gender discrimination.

 

Federal law states:
"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance."

Harassment Definitions

Sexual harassment is unwelcome sexual- or gender-based verbal, written, online, and/or physical conduct.

 

"Sexual harassment in education includes any unwanted and unwelcome sexual behavior that significantly interferes with a student's access to educational opportunities. The Supreme Court has confirmed that schools have an obligation under Title IX to prevent and address harassment against students, regardless of whether the harassment is perpetrated by peers, teachers, or other school officials" (Title IX, 1972).

  • Unwelcome physical contact
  • Continued expression of sexual interest after being informed that the interest is unwelcome
  • Requests for sexual favors
  • Persistent requests for a date, telephone calls, emails or other communication that is unwelcome
  • Posters, photos, cartoons, or graffiti that are demeaning or offensive
  • Sexual language and/or jokes of a sexual nature
  • Unwelcome visual contact, such as leering or staring at another person
  • Comments or statements that are demeaning, humiliating, suggestive, insulting, vulgar, crude, or lewd
  • Sexual gestures
  • Following or stalking
  • Taking pictures that are sexual in nature
  • Preferential treatment or promise of preferential treatment for submitting to sexual conduct



Complaint Information

Title IX of the Education Amendments of 1972 (Title IX) prohibits discrimination based on gender in educational programs which receive federal financial assistance. Programs and activities which may be included are: admissions, recruitment, financial aid, academic programs, athletics, housing, and employment. Title IX also protects male and female students from unlawful sexual harassment in college programs and activities.

Northampton Community College does not discriminate on the basis of race, color, age, gender, gender identity, sexual orientation, sexual identity, religion, national origin, veteran status, disability, genetic information or any other basis of prohibited discrimination in its programs and activities. This policy extends to employment, programs and admission to the College.

 

Federal law prohibits discrimination on the basis of gender (Title IX of the Education Amendments of 1972) and disability (Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act of 1990)
